Debt Collections Defense

The Process

If you are sued by a debt collector, you have 28 days to respond to the lawsuit. If you fail to respond to the lawsuit, a judgment will automatically be entered against you for the amount that the creditor claims to be owed. A judgment allows a creditor to garnish your wages or bank account to collect on the debt. Contacting and hiring an attorney as soon as possible after you are served with the lawsuit, will ensure that you are able to utilize all options available to you. The process of going through a lawsuit is complex and stressful. Our office can provide legal representation to make this process easier If you have been sued by a creditor/debt collector, contact our office today.

Creditors and Collection Attorneys

Some original creditors have their own collection departments. Those that do not have their own collection departments will hire outside agencies to collect for them. Sometimes, creditors will sell your debt to another company. These other companies and collection agencies are third-party creditors. If a debt reaches the point in the collection process when it is time to file a lawsuit, the creditor will hire a collections attorney to file the lawsuit and collect on their behalf.
